Terms of Use – OuiLive

These Terms of Use (hereinafter the ‘Terms’) are proposed by the company OuiGroup, a simplified joint-stock company with a capital of 13 500 euros, registered in the Paris Trade and Companies Register under number 889219234, of which registered office is located at 23-25 rue de Prony 75017 Paris (hereinafter ‘OuiGroup’). OuiGroup is the owner and publisher of the application OuiLive (hereinafter the ‘Application’)

  1. APPLICATION OF TERMS

The purpose of these Terms is to define all the conditions under which OuiGroup allows users to use this Application (hereinafter the ‘Users’). Any User declares having read and accepted these Terms before using the Application. In the event that the User disagrees with one or more of the provisions of these Terms, he is requested not to use the Application.

  1. ACCESS TO THE APPLICATION

Before any use of the Application, the User must ensure that he has the technical resources to use the Application ensuring in particular that the technical configuration of his mobile is in good condition and does not contain any virus.\nOuiGroup implements all measures to ensure the User access to the Application, in optimal conditions, 24/24 and 7/7. However, it can not under any circumstances be held liable in the event of unavailability of the Application due to internet failure, bugs or operating errors making it impossible to access the Application. Access to the Application may also be terminated temporarily in the case of maintenance operations.

  1. USER ACCOUNT

In order to use the Application, the User must first create a user account on the Application.\nIt is the User’s responsibility to maintain the confidentiality and security of his login credentials. The User must inform OuiGroup immediately of any unauthorized use of his credentials. OuiGroup can not be held responsible for any loss or damage resulting from a fault or negligence of the User to protect his identifiers.

  1. USERS OBLIGATIONS

The User agrees to comply with all the provisions of these Terms.\nThe User agrees that he uses the Application only for his personal use, in accordance with these Terms. In this regard, the User abstains:\n- To use the Application in any way illegal, for any illegal purpose or in any way incompatible with these Terms.\n- To alter or artificially modify the data of use and performance on the Application to artificially distort or improve the performance and results of the User and consequently the results / rankings of the challenges,\n- To open more than one User account or open an account usurping the user’s identity of a third party.\n- To sell, copy, reproduce, rent, loan, distribute, transfer or sub-license all or part of the content contained on the Application or to decompile, extract, disassemble, modify, display in user-readable form, attempt to discover any source code or use any software that activates or includes all or part of the Application.\n- Attempt to gain unauthorized access to the system application or to engage in any disruptive activity, decreasing the quality or interfering with performance or deteriorating the functionality of the Application.\n- To use the Application for abusive purposes by voluntarily introducing virus or any other malicious program and attempt to gain unauthorized access to the Application.\n- Infringe the intellectual property rights of OuiGroup.

  1. PERSONAL DATA

The User is informed that OuiGroup processes personal data belonging to him via the Application. The treatment of personal data by OuiGroup is more fully detailed in its Privacy Policy.\nIn accordance with applicable regulations regarding the protection of personal data, the User has the rights to oppose, to access, of limitation, rectification, portability and deletion of personal data concerning him, as well as a right to object for legitimate reasons and withdrawal of his consent, by contacting OuiGroup at the address following: confidentiality@ouilive.co\nFor technical reasons, some users will have to go through the Google Fit application in order to use OuiLive, in which case the user should check the Google’s Terms Of Service.   1. INTELLECTUAL PROPERTY

The Application as well as all of its elements and contents are protected by copyright, trademarks, designs and / or any other intellectual property rights. All of these rights are reserved for the entire world.\nNo title or right to any element or software will be obtained by downloading or copying elements of the Application. It is strictly forbidden for the User to reproduce (except for his personal and non-commercial use), publish, edit, transmit, distribute, show, remove, delete this Application and the elements and software contained therein, any more than to modify or do any work by taking these protected elements as a basis.\nThe name and brand of OuiGroup or OuiLive, the associated challenges and creative concepts, logos, designs, stylized letters, figurative marks, and all the signs represented on this Application are and will remain the exclusive property of OuiGroup. Any use by the User of the aforementioned elements, corporate names, trademarks and separate signs belonging to OuiGroup is strictly prohibited except with the express and prior consent of OuiGroup.

  1. MEDIATION / DISPUTE

In the case of a dispute that may occur during the interpretation and / or execution of these Terms or in relation to these Terms, the User may decide to submit the dispute with OuiGroup to a conventional mediation procedure. Or any other alternative method of dispute resolution.\nThe User may visit the Online Dispute Resolution Platform (ODR) set up by the European Commission at the following address and listing all the dispute resolution bodies approved in Europe: https://webgate.ec.europa.eu/odr/.\nIn case of failure of this mediation procedure or if the User wishes to seize a jurisdiction, any dispute will be settled before the competent courts.
